The California Lemon Law Applies to All Defective Vehicles Under the Manufacturer’s Warranty

The California Lemon Law states that a new or used vehicle that is still under the manufacturer’s warranty is considered a lemon if:

  • A defect substantially impairs the performance, safety, or value of the vehicle
  • The defect has not been repaired after a reasonable number of attempts
  • The vehicle has been out of service for at least 30 days, which do not have to be consecutive

That applies to gas-powered, hybrid, and electric vehicles.

One example is the 2017 and 2018 Chrysler Pacifica plug-in hybrid minivan.

The manufacturer is warning owners not to charge their vehicles due to a fire risk that is likely due to the corrosion of an electrical connection involving Pacifica’s 12-volt battery system.

The risk of fire is not confined to a charging vehicle. In fact, the manufacturer is warning owners not to park the Pacifica in an enclosed space, including a garage or structure, as it may catch fire even when it is not plugged in.

Chrysler does not have a solution for the fire hazard yet and will alert owners to the remedy once they do. In the meantime, if your electric, hybrid, or gas-powered vehicle cannot be used due to a potential safety hazard, you may have a lemon law claim in California.
